Terms of Service

1. Acceptance

By creating an account or using the Wahilens service you agree to these Terms of Service. If you do not agree, do not use the service.

2. The service

Wahilens provides website analytics and session-recording tools that help you understand where visitors get stuck. We grant you a limited, non-exclusive, non-transferable licence to use the service for the duration of your subscription, subject to these terms.

3. Your account

You are responsible for keeping your login credentials secure. You must notify us immediately of any unauthorised access. You may not share your account with others or create accounts on behalf of someone else without their consent.

4. Acceptable use

You agree not to:

• Use the service for any unlawful purpose.
• Install the Wahilens script on websites you do not own or have permission to track.
• Attempt to reverse-engineer, scrape, or interfere with our infrastructure.
• Collect or process sensitive personal data (health, financial, biometric) through our service without appropriate safeguards.
• Resell or sublicence the service without written permission.

5. Payment and cancellation

Paid plans are billed monthly or annually in advance. All fees are non-refundable except where required by law. You may cancel at any time; your access continues until the end of the current billing period. We may change pricing with 30 days' notice.

6. Data and privacy

Your use of the service is also governed by our Privacy Policy. You retain ownership of the data collected on your websites. You grant us a limited licence to process that data solely to provide the service to you.

7. Intellectual property

All software, designs, and content that make up the Wahilens service are owned by us or our licensors. Nothing in these terms transfers any intellectual property rights to you beyond the limited licence to use the service.

8. Disclaimers

The service is provided "as is" without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that data will never be lost. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service.

9. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising under these terms is limited to the amount you paid us in the 3 months preceding the claim.

10. Termination

We may suspend or terminate your account if you violate these terms. You may stop using the service at any time. Upon termination, your data will be deleted in accordance with our retention policy.

11. Changes to these terms

We may update these terms. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use after that date constitutes acceptance.
